By accessing or using Leadentify ("Service"), including creating an account, browsing the website, or using any feature, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Leadentify is a B2B lead generation and cold outreach platform. Users can discover, import, enrich, and contact leads - all from their own inbox. Key features include:

• Lead import via CSV/XLSX or manual entry
• Lead discovery by prefered criteria
• Email discovery via third-party providers
• AI-powered email draft generation
• Email sequence scheduling and sending via connected inboxes
• Response tracking and lead status management

Leadentify is a tool, not a data broker. Leads are generated or imported on-demand, stored per user, and never reused or resold across accounts.

When you create an account, you agree to:

• Provide accurate, complete, and up-to-date registration information.
• Maintain the security of your account credentials and not share them with third parties.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

You agree not to use the Service to:

• Violate any applicable anti-spam legislation, including CAN-SPAM, GDPR, and ePrivacy regulations.
• Upload, transmit, or store any content that is unlawful, harmful, defamatory, or infringes on third-party rights.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service.
• Use automated systems (bots, scrapers, crawlers) to access the Service without prior written permission.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Service for any purpose that is illegal under applicable law.

You are solely responsible for ensuring that your use of the Service, including any outreach campaigns, complies with all applicable laws and regulations in your jurisdiction.

The Service and its original content, features, and functionality are and will remain the exclusive property of VHApps Mateusz Anikiej and its licensors. The "Leadentify" name, logo, and branding are trademarks of VHApps.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without prior written consent.

The Service integrates with third-party providers to deliver its functionality. These include, but are not limited to:

• Google Gmail API - for sending emails on your behalf via your connected inbox
• Hunter.io - for email discovery and enrichment
• Mistral AI - for AI-powered email draft generation
• Stripe - for payment processing
• Plausible Analytics - for privacy-friendly website analytics

Your use of these third-party services is subject to their respective terms of service and privacy policies. We do not guarantee the availability, accuracy, or reliability of any third-party service and disclaim all liability arising from their use.

Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the data practices described therein.

Certain features of the Service may require a paid subscription. All payments are processed securely through Stripe. By subscribing, you agree to:

• Provide accurate and complete billing information.
• Authorize recurring charges for subscription plans until you cancel.
• Stripe's Terms of Service, which govern all payment transactions.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods unless required by applicable law.

EU consumers: Under EU law, you have a right to withdraw from a digital purchase within 14 days. However, by accessing and using the Service immediately upon purchase, you acknowledge and agree that you waive this right of withdrawal once the digital content delivery has begun, in accordance with Article 16(m) of the Consumer Rights Directive (2011/83/EU).

The Service is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• Email deliverability, open rates, or response rates will meet any specific expectations.
• Data obtained through the Service (including enrichment results) will be accurate, complete, or current.
• AI-generated content will be factually correct, appropriate, or suitable for your specific use case.

To the maximum extent permitted by applicable law (including the Polish Civil Code), VHApps Mateusz Anikiej shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to use the Service.
• Any conduct or content of any third party on or through the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless VHApps Mateusz Anikiej, its officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or regulation, including anti-spam and data protection laws.
• Content you upload, transmit, or send through the Service.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.

Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Poland.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where practicable, by sending a notification to the email address associated with your account.

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes.
